Homestead - Kansas Bankruptcy Exemptions

Only one of the following exemptions may apply to you:

  1. Up to 160 acres of farmland.
  2. One acre in a city/incorporated area.
  3. One manufactured/mobile home you live in.

Wages

Up to 75 percent of your disposable income.

Automobiles

Up to $20,000 of one motor vehicle. If you’re disabled, your vehicle exemption may exceed $20,000.

Personal Property

  1. Furnishings, equipment, food, fuel and clothing necessary for one year.
  2. Burial plot/crypt.
  3. Up to $1,000 for jewelry.
  4. Up to $7,500 of books, documents, furniture, instruments, tools, equipment, implements, livestock, seed, grain growing plants.

Chapter 13 Bankruptcy is dually called “reorganization”. Individuals who file Chapter 13 may own more property and by filing Chapter 13 may also keep most of their assets.

In Chapter 13 bankruptcy, the individual draws up a proposal for a repayment plan for a term of 3 to 5 years, which has to be approved by a bankruptcy court. This installment plan allows the debtor to repay past bills.
