Homestead

A residence worth up to $15,000.

Wages

  1. 90 percent of gross earnings for the head of household.
  2. 75 percent of gross earnings for all other debtors.

Automobiles

Up to $3,000 worth of automobiles.

Personal Property

  1. Up to $3,000 worth of household furnishings, household goods, clothing, appliances, books, animals, crops and musicals instruments.
  2. Up to $1,500 worth of wedding rings.
  3. Up to $500 worth of other jewelry.
  4. Up to $600 worth of miscellaneous property.
  5. Up to $3,000 worth of trade books, tools or implements.
  6. Any mobile home house as a primary residence worth up to $5,000.

Chapter 13 Bankruptcy is termed “reorganization”. Those filing Chapter 13 may own more property thus by filing Chapter 13 may also retain most of their assets.

With Chapter 13 bankruptcy, the debtor draws up a proposal for a repayment plan for a term of 3 to 5 years, which must be approved by a bankruptcy court. This plan allows the individual to pay back outstanding bills.
