Montana State Exemptions

Homestead

A home worth up to $250,000.

Wages

75 percent of a filer’s gross earnings.

Automobiles

An automobile worth up to $2,500.

Personal Property

  1. Up to $4,500 worth of the following items, with no single item worth more than $600: household goods and appliances, jewelry, books, firearms and sporting equipment, clothing, feed, animals, crops and musical instruments.
  2. Up to $3,000 worth of implements, professional books and trade tools.
  3. 100 percent of professionally prescribed health aids.

Chapter 13 Bankruptcy is designated as “reorganization”. Persons filing Chapter 13 may own more property and by filing Chapter 13 may also keep most of their assets.

In Chapter 13 bankruptcy, the filer draws up a proposal for a repayment plan for a term of 3 to 5 years, which must be approved by a bankruptcy court. This plan allows the filer to repay outstanding bills.
